Mitt Romney's father was born in Mexico. So how could he run for president?

This isn't meant as an expose or attack of any kind. It's just something I was thinking about during all the Romney biopics at the Republican Nation Convention (and CNN's Romney Revealed!) Mitt's father George Romney was a popular governor of Michigan and was briefly the front-runner for the Republican nomination for President when he ran in 1968. (He dropped out after a series of gaffes.) But George Romney was born in Chihuahua at a Mormon colony there. So how could he have qualified to be president if he was born in Mexico? 
When John McCain was running for president in 2008, congress quickly passed some sort of an exception allowing people born on U.S. military stations abroad to qualify for president. (McCain was born in Panama.) But that was in 2008, and a Mormon polygamous colony is hardly the same deal. Did anyone ever ask to see Romney's birth certificate? 

I'm just wondering because this seems to not make sense.

Questions were occasionally asked about Romney's eligibility to run for President due to his birth in Mexico, given the ambiguity in the United States Constitution over the phrase "natural-born citizen". His Mormon paternal grandfather and his three wives had fled to Mexico in 1886, but none of them ever relinquished U.S. citizenship. Romney's parents chose U.S. citizenship for their children, including George.The family fled Mexico and came to the United States in 1912 during the Mexican Revolution. By February 1967, some newspapers were questioning Romney's eligibility given his Mexican birth. In May 1967, the Democratic chair of the House Judiciary Committee, Emanuel Celler, said he had "serious doubts" about whether Romney was eligible, but had no plans to formally challenge the matter. Another member of Congress made a case against Romney the following month. In response, the New York Law Journal published an article by a senior attorney at Sullivan & Cromwell arguing that Romney was, in fact, eligible. The Congressional Research Service also came down on Romney's side, as did most other constitutional experts at the time. During the campaign, Romney was generally considered a viable and legal candidate for United States president. He departed the race before the matter could be more definitively resolved, although the preponderance of opinion since then has been that he was eligible.

That's pretty interesting that, 45 years ago, someone who was known to be born in Mexico - and four years ago, someone who was known to be born in Panama - was generally considered eligible to run for President. Or that the interpretation of "natural-born citizen" has changed over the years. Perhaps it's time to revisit how much sense that vague and xenophobic qualification makes in the 21st century, especially when it's only uses are to prevent qualified people from being president, and to fuel a racist conspiracy theory against a sitting president.

Donald Trump: WHY WON'T YOU RELEASE YOUR BIRTH CERTIFICATE!?

Potential Republican Presidential Candidate Donald Trump released his birth certificate to Newsmax this week. However, he only released a internet image of a short-form, probably faked document. Patriots of this country are now left to wonder: WHY WON'T HE RELEASE HIS BIRTH CERTIFICATE? Here is the "image" he "released":

Several glaring questions are now raised in this new festering conspiracy:
1) Even if this document is legitimate, it still does not say anywhere on it that Jamaica Hospital is in New York, U.S.A. This could be Jamaica, Jamaica, or, more probably, Jamaica, Libya. (That's right: Libya, hostile nation to U.S.A. and also an atheist mooslim country in North Africa.)
2) The document uses wordage like "whereof" which is silly and I have never seen a real birth certificate using the word "whereof" therein, therefore it is clearly a forgery thereof. Q.E.D.
3) Two words: LOOSE SEAL. (Mother!)
4) Speaking of mothers, Donald Trump's was Scottish. So even if Trump was born in Queens in 1946, her British citizenship would make Trump an alien limey, a citizen of the British Empire (including Kenya), and it would be illegal for him to also be a citizen of the U.S.A. (as it clearly says in Article X-49 in the Constitution.) We have never had a President who was born in the British Empire (except for Washington, Adams, Jefferson, Monroe, Adams, and Jackson.)

Do the right thing, Trump. Put this controversy to rest. If you aspire to be the President of the United States, RELEASE YOUR BIRTH CERTIFICATE!

News: Don't Ask Don't Tell repeal signed by Obama today

This is a nice anecdote at the bottom of the New York Times article about the Don't Ask Don't Tell repeal signed this morning:


The audience for the ceremony included a who’s who of gay activists, among them Frank Kameny, who was fired from a civilian job as an Army astronomer in 1957 — an act that prompted him to found a gay rights advocacy organization in Washington D.C. and to file a lawsuit which went all the way to the Supreme Court. In 1965 he picketed the White House, in the first ever demonstration there by gays.

Now white-haired at 85, Mr. Kameny also served as an enlisted Army soldier; he signed up in May 1943, he said, three days before he turned 18, and saw “front line combat” in Germany during World War II. He said he was asked if he had “homosexual tendencies” and denied it. “They asked, and I didn’t tell,” he said, “and I resented for 67 years that I had to lie.”

Grainne's Lunch-Break Political Roundup

This day in the Judiciary:
There is a case currently being argued before the U.S Supreme Court, brought against the NFL by American Needle, an Illinois maker of souvenir caps that is pissed about what it alleges is a violation of the 1890 Sherman Anti-Trust Act- this because the NFL sold a 10-year monopoly license for making souvenir caps (for all teams except the Dallas Cowboys, who opted out of the license, choosing to continue to license their logo separately) to Reebok. The oral arguments that took place before the court on Wednesday turned out to be pretty funny, and actually made me sort of regret that I didn’t go to law school a few years ago when I almost went to law school. The tangle everyone kept getting into was to what degree individual teams should be viewed as separate entities, and to what degree the existence of the League as a collective body that has common commercial interests (and commonly held responsibilities to set game rules and playoff schedules etc.) trumps the actual (and legal) identity of individual franchises as competitors of one another. The lawyer for the NFL argues that NFL souvenirs and the licensing for the production of them could not be considered as ordinary products subject to competition laws (and thus, anti-trust suits) because they are a promotional product for a sport, rather than an independent source of profit for any one franchise. The license to Reebok was granted by the league, and thus, by an embodiment of the sport of Football, furthering it's own footbally interests in the name of football. So far this argument had held up well in the lower courts. It ended up at SCOTUS after being handed up without a trial after multiple appeals from American Needle.
The Justices of our highest court seemed to be quite enjoying this case. Justice Stevens wondered aloud about a hypothetical situation in which the NFL decided to sell houses instead of small merchandise. Justice Roberts added “he is just saying that selling logos is closer to selling houses than it is to playing football”, and suggested that a trial was the place to sort out the facts. Justice Breyer however, made possibly the most relevant point when he noted, quote: “Okay. I don’t know a Red Sox fan who would take a Yankees sweatshirt if you gave it away”.


This day in the Legislature (and the Executive too, kinda):

Guess what? We might actually get health care reform legislation signed into law before the State of the Union! Apparently, Pelosi, Reid, and their attendant mafias are working so hard on coming up with a joint bill for Obama (who also apparently spent a good deal of time in attendance at these meetings) to sign that “Lawmakers shed their cell phones and blackberries” (quote from the Bay Area News Group’s Morning Report) while meeting to hash out the legislation- and we all know about Congress and their crackberries. They’re always tweeting instead of listening to each other spew bullcrap from the podium. The thought of Congress-people actually leaving their ‘devices’ off, or outside of the room they’re occupying does lend a note of gravity to the proceedings. It’s almost like they’re actually working.
It is quite interesting what they’re getting hung up on, though, at this stage in the game. Abortion coverage in Federally subsidized health care programs? Nope. Expansion of Medicare and Medicaid? Nope. A ‘Public Option?’- Nope. Many of these things that were included in the House bill and scrapped from the Senate bill will, in my opinion, never find their way onto the President’s desk. The big hangup in crafting a joint bill is a tax that Obama himself has asked for on high-cost private insurance plans. House Democrats don’t have a reputation for being particularly centrist, and are most certainly beholden to certain interests, such as….hmmm…who could be behind wanting to block this tax? That’s right, it’s Organized Labor. We’re talking serious muscle old-line huge labor unions. AFL-CIO, UAW….those dinosaurs of labor. Why? Because the rank and file of these Unions gets the best fucking health insurance out there, and they don’t want their Union Members to pay a tax on their sweet insurance coverage. Problem is, those old-time Union members with the 50 dollar and up an hour jobs and the swell pensions and the A-plus benefits are a dying breed, and a growing number of us are part of the next paradigm of proletariat- the paradigm that currently is underpaid, unorganized (in many cases unorganizable) and without any benefits (health, retirement, anything) at all. And we need the re-structuring of our healthcare system (and government subsidies for the health coverage of a huge number of previously vulnerable people) to be Financially viable. The tax on high-cost private health insurance plans that Obama wants is one way of taking from those who are currently making out like bandits because they’ve basically been grandfathered out of the current ‘fuck the worker’ labor market, and making the future for all of us more than a totally untenable idea written in a book that can never be balanced. So, Old Line Labor Unions and your big muscly lobbies, I love ya, I mourn your demise, and I do hope you can negotiate this tax down from the 40% Obama is proposing to something more reasonable like a 15% or 10% tax (probably what Obama was expecting and why he aimed high in the first place) but for christ’s sake, get on board, think about the world after and outside of you and open your minds to the possibility of a world in which we need good healthcare for everyone, not just amazing healthcare for a few.
A note about the health care bill that is almost certainly going to be signed into law within the next couple of weeks:
The left is pissed about it, I know. Many have called for this bill to die rather than pass. Though this bill is far from ideal, I am not among them. First of all, this bill is not the end-game. It is the toehold, and much progress should come incrementally in it's wake. This bill is not going to include lots of nice things that would make me stop being jealous of Dutch people. Yes, it is retarded that this country will never have a single-payer system because a majority of Americans will never agree to pay the taxes needed to make such a system possible. However, this bill is going to make it illegal for the Health Insurance industry to fuck us all in the ass like it has been doing, totally unchecked, for all of my lifetime and back into the days when I was just a twinkle in my mother’s eye. Artificial price-gouging, excluding people from coverage because of pre-existing conditions, dropping people right when they need coverage or rejecting claims for laughable and unfair reasons (“we won’t pay for your Chemo because you had Acne when you were 15”), these will all be straight up illegal. And regulated. Which they currently are not at all. To me, new regulation and new laws governing the practices of the private health insurance industry alone is enough of a reason why it would be tragic for this bill to have died in either chamber of Congress. This is an industry that has criminally abused the American People for decades and which desperately needs to be smacked back into line. The political moment to smack them is upon us and almost past. I am sure that the pending legislation will do much (if perhaps not enough-remains to be seen) smacking of those who should be smacked. I’ll keep it at that for now, but I plan on saying more about this whenever the joint bill becomes available on these interwebs and I can get a look at it.

The Naughties End - The Tweens Begin


While there's a raging debate about what to call this decade - the New York Times solicited catchy tags from readers here - has anyone noticed that the next decade will also pose a problem: teenage years don't start until 2013. So I heartily welcome the Tweens, which, according to my research into preteenism, begin at 10. A portmanteau, the wikipedia tells us "Tween is an American neologism and marketing term for preteen. A blend of between and teen, tween in this context is generally considered to cover the age range from eight to twelve years." So, by different definitions, we're either hot in the middle of the Tweens, transitioning into them, or drunk on Tween eve - whatever the rate of this decade's preadolescence. It's true that the Obama era, in all effect, came on in 2008, & eras don't always line up perfectly with even numbers. (The twentieth century, for instance, didn't really get started until The Rite of Spring & World War I, & end until September 2001 or November 2008 depending on your political leanings.)


Back to the 2000's, I was just remarking to Miss Anna Greenberg that "It says a lot for our culture that we've been living thru it for ten years & haven't really started to call it anything. How can half a billion English speakers just tiptoe around the issue for ten years!" She responded: "how can we call it something when it hasn't ended yet!" That's true, but it's an issue that's periodically come up in the periodicals. I've always favored the naughties, or the naughty-aughties. (This year would be called "Two-naughty-aughty-nine" or "Two-naughty-naughty-nine," as I say in the MC Pseudo-Dionysius song Hillelujah.) We'll see what sticks, or if people will just eternally say "that decade".

UPDATE: I say, in celebration of the breaking dawn of the Tweens, celebrate by going out to see New Dawn! It's hard to predict the future, but easy to say with certainty that the tweens are characterized by Twilight, Twitter, Obama, tea parties, Glee, & of course itwaslost artists & writers. L'Chaim! Weblogging & landgrabbing & jackassing

I'm sorry this blog has been a bit quiet, but I've been spending a lot of my time online playing Landgrab with our bulgarious friends. It's the Risk board game on a pretty nifty website, but you can play on hundreds of different maps. Like this elegant one, "ShowMR" by Foist, we've been playing on:


The last time was a long game, all the continents are so interconnected (there's sea passages around the edges of the board), that everywhere feels like you're fighting for Asia. The continents have bizarre names like "Rap the Musical" & "Nature's President". You can also play on Pangaea. You can play in Belgium or the Great Lakes. You can play for Istanbul. You can play on the moon, on the Monopoly board (the most confusing board in my opinion), on The Band's Big Pink house, Star Wars' Millennium Falcon. I know this is a lame excuse for writing less, but there you have it, & let us know if you want to play with us.

The off-the-record recording where Barack Obama called Kanye West a "jackass" this week was leaked & ubiquitous now.



I asked Mrs Eley-Nelson if she thought, in her weathered English opinion, that he had had a few pints. She replied "I see what you mean. He sounds like a disney drunk.
Whu'du'ya'mean.... kind of thing. Hic." It's nice that we no longer have a teetotaler in the White House, but, I said, "So you agree? He shouldn't risk being recorded when he's unwinding in the Lincoln bedroom with a few Nixon martinis." Nixon's martini, he stole the recipe from Winston Churchill, is to pour a glass of gin & glance across the room at the vermouth.

As for Mr West, I hate to say it, but the whole event seemed a little staged to me, & it'll probably help everybody's record sales. He'll probably call his next album The President's Jackass or something.

"Stop Him!" & "Follow That Car!"

Go to a metropolitan park. When a bicyclist bikes by, perhaps shriek & yell "Stop him!!" Hopefully, three burly men will chase down the bike & tackle him. By this point, of course, you'll be long gone. (A scooter could help in your swift departure in the other direction.) The humor, which you can only imagine, is the baffled interaction between the helpful men & the cyclist. For safety, make sure you target a biker with protection, unlike this man setting a bad example:


A related prank is running up to & jumping in a taxi & yelling "Follow that car!" Hopefully the taxi driver will run red lights & cut off cars while changing lanes to keep up with whichever unsuspecting car you've targeted. Who knows, you might end up in New Jersey!

Welcome Obama Babies! goodby Orly Taitz (attorney, dentist, real estate agent)

If you recall, there's always a peak in baby births nine months after a major city power outage. November 4th, there was a similar romance in the air, look how often I got kissed on Valencia Street in San Francisco:



So people were predicting a surge in babies nine months later - which is TODAY! And the amazing thing - today is of course also President Obama's birthday. And just to make everything come full circle, Obama was born on August Fourth, 1961, which means he was born exactly nine months after John F. Kennedy's election victory. (We wrote more about the Kennedy-Obama coincidences in this post: Su Diarrea Diaria). Welcome Obama babies! & into the world, very likely, the woman or man who'll be elected President in 2056.

The bizarre birther Orly Taitz has gotten herself back onto the news networks with a forged Obama Kenyan birth certificate. The birther movement is appropriately reaching its climax on Barack Obama's birthday. People are complaining this woman is getting so much face time on cable, but come on! she's truly terrific. For the sake of our international AUDIENCE what hasn't been following this, here's a recap from Jon Stewart:

Letter to Barack Obama: "stop smoking NOW"

Man, I loved these letters to Barack Obama that the New York Times posted today, with his responses. There was an article about the White House mailman, who sorts thru the thousands of incoming mail to give ten a day to the President. "We pick messages that are compelling," he said, "things people say that, when you read it, you get a chill." I wish they'd post more of them, & not just the touching ones. Writing to the President is an interesting art form, I assume attracts a lot of eccentrics. It's like Pascal's Wager: I guess the tiny chance it would be read outweighs the likeliness of its insignificance.

Teabagging Update

It's tax day, & time to rise up against this fascist TAXATION WITHOUT REPRESENTATION! For instance, I asked Barack Obama in a STRONGLY-WORDED LETTER to eradicate time-differences. Time Differences set Nation against Nation & subdivide the sunlight in increasingly unfair ways. Obama has been in office for several months & I'm still drinking coffee in Berkeley while I gee-chat with Mr Quill, drinking beer in Bulgaria, & VISA VERSA. Is this what I'm paying taxes for? I'm drinking some really delicious PG Tips with steamed soy milk, dumped in the Potomac of my cup.

Here's my favorite Teabagging report from the day's news:

The big event of the day was to be the dumping of one million teabags. The Washington Post notes that this was originally supposed to happen at the Potomac River but was shifted to Lafayette Park because of issues of legality. [...]

But! As it turns out, the alternate plan -
1. Take a milli
on teabags to Lafayette Park,
2. Dump them on a tarp,
3. Yell at them,
4. Clean up the teabags
- also isn't happening, because of permit issues.
According to reports, the truck filled with teabags pulled up to Lafayette Park, but didn't have a permit, and so they were loaded back on to the truck and driven off to an undisclosed location.

Caleb Burhans' Election Night Requiem

I just found this video while I was doing my myspace schmoozing for the new celestial hip-hop page. Will Faithfully Execute the Grammar Shibboleths



Whenever there's an article in the New York Times about grammar, it becomes one of the most e-mailed articles of the day. I conclude from this: the types of people who e-mail articles from the New York Times are also sticklers for grammar. This one takes the opposite approach, boldly dissing them:

Language pedants hew to an oral tradition of shibboleths that have no basis in logic or style, that have been defied by great writers for centuries, and that have been disavowed by every thoughtful usage manual. Nonetheless, they refuse to go away, perpetuated by the Gotcha! Gang and meekly obeyed by insecure writers.
I don't know what a shibboleth is, but I'm against them by default. Is it like a santorum saddleback? I also propose that "gotcha" be banned from the main stream media. The grammatical rule in question has something to do with placing an adverb in between infinitive markers & auxiliaries, (like "to boldly go" for Captain Kirk, or "I will always love" Dolly Parton, which would both be illegal). Apparently, Chief Justice Roberts is a grammar nazi, & in previous legal opinions has taken such extreme measures as expurgating the "ain't" from the Bob Dylan quote "When you ain't got nothing, you got nothing to lose." Where they're going with this, was that Roberts was subconsciously correcting the constitution when he messed up the wording in Obama's constitutional oath, moving the "faithfully" around in "solemnly swear that I will faithfully execute the office of president of the United States." I would prefer to lean towards the conspiracy that aliens are preventing Obama from officially faithfully taking office.

Day One: Text Chatting the Former President

There was an amazing typo in today's San Francisco Chronicle, underneath the large photo on page A5, the caption read:

President Obama and first lady Michelle Obama
text chat with former President George W. Bush and Laura Bush on the Capitol steps.


The caption on their website has been fixed to eliminate the word "text", probably left over from the layout draft. But the idea of the new president "text chatting" the former president, especially when he's standing just right next to him, really heralds a new generation of leadership & the dawn of 21st Century American government.

Recipe: Inauguration Luncheon at Ashby Ave, Berkeley, California

Did you hear Barbara Feinstein, as she was commencing the post-Inauguration fancy luncheon? She said the most-viewed webpage at the Inauguration site was the one with the recipes for the lunch. So, in full anticipation that this will be my most popular blog post ever, I'm publishing the recipe for my post-Inauguration-live-weblogging lunch-in.

Obama Nachos
-Preheat oven to 350
°
-Pour a bag of tortilla chips onto a pizza tray. (I used Casa Sanchez Thick & Crispy Gruesos, a bay area favorite brand.)
-Sprinkle with shredded Tillamook cheddar cheese.
-Black beans
-Bake until the cheese is melted
-Add salsa (Casa Chicas RedGreen salsa, delicious from Zacatecas, Mexico), & guacamole, creme, whatever you want, to your taste.
I suggest pairing this with a dark beer, the earlier in the afternoon the better, I recommend San Francisco's rich Anchor Porter ("because porter is the new black president, bitch" as the Tracy Jordon slogan goes). Merry New Administration!
